All India campaign Against Death Penalty

For a decade, capital punishment in India had been on hold. However, the two secretive executions of Ajmal Kasab and Afzal Guru as well as the rejection of 23 mercy petitions by the President have renewed the abhorrent trend of death by hanging. Fortunately, the recent Supreme Court judgment has upheld the basic human rights for the death row convicts as it has expressed displeasure at the arbitrariness meted to them by the state and has commuted 15 death sentences. Despite the Court’s intervention, eight known convicts continue to languish on the death row and another 450 or more condemned prisoners remain under its hateful provision in different jails across the country. The recent developments have once again underlined the absurdity and horrifying nature of death penalty and have invigorated the demand for its repeal. Besides its barbaric form, capital punishment is premised upon an unfair and discriminatory application of judicial procedures, which raises the specter of miscarriage of justice. The irrevocable nature of the punishment and the violation of the inviolable right to life leave little room for believing that it is a just and reasonable punishment for heinous crimes. Moreover, the argument that death penalty is necessary because of its deterrent influence on future crime, is not only unsound but also untrue. Death penalty is a cruel and barbaric solution of a weak state that is incapable of fostering a more equal and democratic society and culture or, of providing an honest and transparent investigation and judicial procedures. It is time for people and organisations from different walks of life to come together and demand the end of death penalty.
